Un libro autobiogr?fico, una excursi?n a la ni?ez, la juventud y los a?os de gobernante de Hugo Ch?vez, ha entrado a ?ltima hora en la campa?a electoral de Venezuela. La obra, titulada Cuentos del ara?ero, hace todas las maromas posibles para dar una visi?n humana y familiar del hombre que descubri?, en 1999, el confort del palacio de Miraflores. Y quiere seguir all? otros seis a?os.

En medio de la guerra de encuestas y con las cifras de indecisos por encima del 20 por ciento de los convocados a los comicios del 7 de octubre, dos escribidores de Cuba salen a ponerle un poco de colorete a la figura del presidente mediante unas 260 p?ginas de vi?etas y fotos. Los episodios, que se cuentan en primera persona, son testimonios tomados por los expertos caribe?os de casi 400 programas de "Al? Presidente" en los que el dirigente venezolano habla durante horas sobre cualquier tema.

En los ?ltimos d?as se han distribuido gratis por todo el pa?s un mill?n de ejemplares de Cuentos del ara?ero. El t?tulo viene de una etapa de la infancia de Ch?vez en la que el futuro presidente ayudaba a su abuela a vender unos dulces de papaya llamados ara?as por los venezolanos.

Quienes trabajan para mantenerlo en el poder llevan ahora el panfleto en su carpeta de propaganda hasta los sitios donde creen que las urnas les ser?n m?s ariscas.

La visi?n de un ni?o humilde que ayudaba a su familia puede suavizar, ante el conflictivo escenario pre electoral, la imagen de intolerante y bullanguero que el se?or de Barinas se ha construido a mandarriazos. En ese pase de maquillaje le ayuda el libro. El problema es que el cap?tulo final est? dedicado a las relaciones de Ch?vez con Fidel Castro.

El mensaje de su maestro no habla del pasado ni de papayas en alm?bar. Contiene el desprecio natural por el valor de los votos y la obsesi?n ?nica del poder.

Es un advertencia (con miedo a?adido) sobre los riesgos de perder frente a la oposici?n. Ch?vez asegura que en una conversaci?n reciente Castro le dijo que si ganaban sus adversarios "la persecuci?n y el arrase ser? general. Ah? no van a perdonar a nadie... Mira el caso de Pinochet".

No se sabe qui?nes escribir?n los pr?ximos capitulos de esa autobiograf?a intempestiva.

Soapy 'Won't Back Down' gets a failing grade

The jury is still out on a solution to the national education system crisis, but the verdict is delivered with a heavy hand and a stacked deck in the formulaic "Won?t Back Down." Simplifying complex school-reform hurdles into tidy inspirational clich?s while demonizing both teachers? unions and bureaucracy-entrenched education boards, the movie addresses timely issues but eschews shading in favor of blunt black and white. It?s old-school Lifetime fodder dressed up in Hollywood trappings.

In the broadest terms, Daniel Barnz?s film, co-written with Brin Hill, is a dramatized counterpart to Davis Guggenheim?s 2010 documentary "Waiting for Superman,? which pointed to charter schools as the only way out of the public-education quagmire. That film was partly financed by Walden Media, the backers of this Fox release, suggesting that the problem of underperforming inner-city classrooms is a pet cause for the company.

In Barnz and Hill?s by-the-numbers screenplay -- which trumpets that vaguest of catch-all legitimization banners, ?Inspired by actual events? -- the catalyst for much-needed change at Adams Elementary School in Pittsburgh is crusading Everymom Jamie Fitzpatrick (Maggie Gyllenhaal). Her dyslexic daughter Malia (Emily Alyn Lind) is stuck in a class with a teacher (Nancy Bach) who is a monster of job-secure complacency, and a principal (Bill Nunn) too mired in unionized paralysis to help.

A single mother working two jobs and unable to afford tuition at better alternatives, Jamie bones up on the ?fail-safe? maneuver, the film?s equivalent of the parent trigger law. That controversial legislation -- on the books in some form in a handful of states and under consideration in many others -- allows concerned parents and teachers to intervene in floundering public schools. In the film?s example, it primarily means getting past restrictive union controls and a do-nothing education board.

The absurd idea that the parents of an entire student body are too apathetic to worry about their kids? education until Jamie comes along like some rocker-chick Erin Brockovich is just one of the film?s condescendingly movie-ish conceits. Played with grating one-note pluckiness by Gyllenhaal, Jamie overcompensates for her lack of a college education by self-consciously sprinkling her conversations with words like ?trepidatious.? Yet, darned if this scrappy dynamo doesn?t get the whole community galvanized.

Even more objectionable is the depiction of the burned-out staff at Adams. They mill around in the break room bitching about teachers like Malia?s, saying, ?The only thing the district does well is protect its mistakes.? But the general lack of motivation is palpable, and even Nona Alberts (Viola Davis), a committed educator like her mother before her, has lost faith in her profession.

The only exception at Adams appears to be Teach For America do-gooder and soulful hunk Michael Perry (Oscar Isaac), who leads his class in line-dancing numbers, accompanying them on ukulele as they sing about ?Goin? to College.? Naturally, this makes Jamie swoon.

A perfunctory romance blooms, but Michael vacillates in his support for Jamie?s cause. Preferring to focus his commitment on his class only, he is reluctant to stray from union-sanctioned guidelines. Jamie?s sole consistent ally is Nona, who risks alienating the entire teaching staff, including her feisty pal Breena (Rosie Perez). While she?s worn down by the challenges of a broken system, not to mention the end of her marriage and the learning difficulties of her own son (Dante Brown), Nona reluctantly gets with the empowerment program.

However, this is another one of those movies where a tenacious white person leads the charge to save inner-city kids, achieving a miracle transformation through sheer force of will. While Nona is the insider with the education experience, she?s second fiddle throughout the fight, getting much of her dignity not from the script but from Davis, who could do this role in her sleep.

In order to provide a gossamer-thin semblance of balance, Barnz and Hill plant one jaded idealist apiece in the teachers? union and the education board. That essentially leaves Holly Hunter and Marianne Jean-Baptiste playing variations on the same role, both of them primed for redemption as they rediscover their buried convictions. Elsewhere, the opposition is reduced -- most notably by Ned Eisenberg?s belligerently uncompromising union chief -- to a force of obstinate blindness as to what?s good for the kids, and for the majority of disillusioned teachers.

Given the disingenuous way in which this lumbering movie pushes obvious buttons and manipulates the audience?s emotional investment while conveniently skimming the issues, it?s a mystery how some of these names got roped in.

Following her breakout work in "The Help," this is a particularly unhappy use of Davis? considerable talents. Hunter also is too smart an actor to be stuck playing the transparent construct of a compromised Norma Rae. Lance Reddick (The Wire) is given an entirely thankless role as Nona?s businesslike departing husband, while Ving Rhames is on hand literally to deliver a speech as principal of the exemplary Rosa Parks Elementary School during a lottery draw for new students.

That scene is one of many such preachy interludes in a dumbed-down agenda film that veers shamelessly between didacticism and soap.

Childhood Obesity Increases Kids' Risk for Heart Disease Later ...

(PCM) As if you needed another reason to keep your kids healthy and active, a new study suggests that obese children develop risk factors for heart disease that usually aren?t seen until adulthood. That?s pretty scary. The risk factors ? including high blood pressure, high cholesterol, high blood sugar levels and even thickening of the heart muscle ? can boost a child?s risk of heart disease by up to 40 percent, say British researchers.

Lead researcher Claire Friedemann, of the department of primary care health sciences at Oxford University reported:

?We really need to take action on childhood obesity from as young an age as possible. We have shown that obesity is not just about appearance but could have a long-term effect on the health of the child. By not fully tackling the problem, we could lose the progress that has been made in treating heart disease in recent years.?

Researchers found that, compared to normal-weight children, obese children had significantly higher blood pressure, cholesterol and blood sugar levels as well as thicker heart muscles, which can increase the risk of heart disease and stroke by 30 to 40 percent when they reach adulthood. (Source)

Being obese in childhood may significantly worsen the risk factors and health consequences associated with adult obesity, including the risk of diabetes, premature cardiovascular disease, and death.

?Although the size of the effect that obesity has on the health of children?s hearts is worrying, the good news is that they can all be improved with a healthy diet and exercise,? Friedemann said. ?These habits are much easier to begin in childhood and carry through to adulthood.?

TSX jumps 1 pct on China cash, Spain hopes

TORONTO (Reuters) - Canada's main stock index jumped 1 percent on Thursday, breaking a five-day fall, as investors cheered moves by China to inject cash into money markets and as Spain unveiled an economic reform plan to deal with its debt crisis.

All ten of the index's main sectors moved higher, led by the heavyweight materials, energy and financial sectors which together account for more than three-quarters of the Toronto Stock Exchange's S&P/TSX composite index <.gsptse>.

By 1:36 p.m. (1736 GMT), the index was up 112.68 points, or 0.92 percent, at 12,345.54, as stronger gold and copper prices boosted miners.

"China is by far the biggest factor in determining commodity prices. Any news perceived as being positive for the Chinese economy tends to help commodity prices and therefore the TSX," said Elvis Picardo, a strategist at Global Securities in Vancouver who has recommended clients buy lagging Canadian commodity stocks for several months.

China's central bank injected 365 billion yuan ($58 billion) into money markets this week to prevent a short-term liquidity crunch at the country's commercial banks.

"This injection by China is consequential," said Gareth Watson, a vice president for investment management and research at Richardson GMP.

The news from China offset data showing weak orders for manufactured goods in the United States, which dimmed the global recovery outlook.

BET ON SPANISH BAILOUT

On Europe, Watson said that investors appeared to be looking beyond street protests against austerity measures in Spain and Greece and assuming that Madrid will eventually request an aid package that would trigger European Central Bank bond-buying.

"The market is looking ahead and finding it very difficult to believe Spain will go ahead without asking for a bailout, so we will react today as if it is already in place," Watson said.

Spain announced a detailed timetable for economic reforms and a tough 2013 budget based mostly on spending cuts seen by many as an effort to pre-empt the likely conditions of an international bailout.

Illustrating the broad nature of the Toronto index's rise, the three gainers with the most impact were a bank, an oil company and a gold miner.

Bank of Nova Scotia rose 1.5 percent to C$54.91, Goldcorp gained 2 percent to C$45.20 and Suncor Energy moved 1.3 percent higher to C$32.44.

But both Watson and Picardo warned that the TSX's rise could simply be a reaction to a five-day sell-off, and that catalysts would be scarce until North American jobless data at the end of next week and corporate earnings season that starts soon after.

Still, a Reuters poll published on Wednesday showed Canadian shares are expected to make further gains this year and into the middle of 2013, as recent stimulus from major central banks is expected to lift lagging resource stocks.

Weighing on the index on Thursday, Enbridge Inc dipped 1 percent to C$38.49 after environmental groups sued the government over the pipeline company's contentious Northern Gateway pipeline.

Research In Motion Ltd dipped 2.9 percent to C$6.68 ahead of its quarterly results due after the close, paring several days of solid gains for the struggling BlackBerry maker.

It has taken me so long to get to where I am now and the end of my journey is when I leave this Earth because the before and after weight loss image is just a snapshot in time ? not truly the end of the road. I finally understand that my level of knowledge, understanding, love, and appreciation for my body gets deeper as I progress along my path. The desire for goals of ?weight loss in 7 days? or ?lose 10 pounds before my class reunion? are trivial. I am proud of where I stand.

Babies Are Making Efforts to Be Independent since Birth

From birth, baby is independently conducting the process of growth. This strength of growth comes from the intrinsic role in their bodies, which is called ?the action with purpose.? This behavior is like one kind of wishes sent out from the bottom of baby?s heart, and it is a driving force for life, but also as a source of human evolution. It is because of this force, you can allow your baby to make all kinds of behaviors in the process of growing up; for example, initial babbling and toddler. If every baby can continue to grow and is promoted by natural forces, then their hearts will be in a state of pleasure.

Therefore, experts feel that the baby itself should be independent, and they should not be subjected to the parents. In other words, if we give enough concern for the baby?s natural development, not hinder, then the baby will gradually reach independence. This will not only apply to their psychological growth, but also apply to their physical growth. The parents must have noticed how the baby yearns to be independent and fully uses their little hands and feet. After the baby is born, they are attracted by the world, and they are greedy to absorb the surrounding culture, knowledge as well as language, all of which are the flags for baby towards independence.

When the baby is about one year old, they start to learn to walk. To that point, they can take control their feet, so they do not need to act under the help of their parents.

At first, out of curiosity, they will always be running around. At this point, their independence is no longer limited to thinking. They are really free and they can actually act.

For the baby, learning to walk is very important. Under normal circumstances, when the baby is six months old, they are able to sit up, and they can crawl until eight months, stand until ten months, and they can walk until twelve to thirteen month. In addition, after the baby gets a skill, they absolutely cannot put them aside and do not use them. After baby gradually gaining the ability to live independently, they will freely use these capabilities, so that develop these ability quickly.

Therefore, since the baby is born, they are making efforts to be independent. During the process, they may encounter some setbacks or some depression, but they do not flinch. At this time, parents should encounter them to grow, but do not hinder them.

Idaho female golf champ can still play with boys

BOISE, Idaho (AP) ? The board that oversees Idaho high school sports won't bar a female golf champion from playing with the boys' team if not enough girls turn out to form a team of their own.

A proposed rule change that would have blocked Sierra Harr's participation emerged over the summer at the Idaho High School Activities Association after she helped the Castleford High School boys win the 2012 championship for Idaho's smallest schools.

Harr, a 16-year-old junior, says the debate came up after rival coaches complained.

Association executive director John Billetz said Wednesday there was just a single vote in favor of the rule change at a meeting in Coeur d'Alene. Billetz says the 11 board members voting in the majority concluded Harr's situation happens so infrequently, it didn't merit a big change.

"Nothing has changed, everything is back to the way it was," he said.

If enough girls turn out to form a Castleford girls' team in 2013, Harr will play with them.

If not, she can still compete for a spot on the boys' team.

Taking a brief break in between classes Wednesday, Harr told The Associated Press that a potentially difficult situation has come to a satisfying conclusion ? not just for her, but for other girls in Idaho.

"If you believe in something ... you should stand up for it," she said.

Harr says the process has been a learning experience and that the resolution will allow her to focus on golf. Her next tournament is this weekend in Sun Valley.

Two years ago, in Harr's freshman season at Castleford, she easily won the individual girl's state title for schools with fewer than 160 students, taking the championship by 6 strokes.

In 2012, however, only three girls turned out for Castleford's girls' squad, one too few to field a formal team.

Rather than play as an individual in female competitions, Harr won the Idaho High School Activities Association's permission to play with Castleford's boys' team ? provided she qualified every week.

Hitting from the same tees as the boys, she finished in seventh at the state tournament in May, helping her 2A school to the boys' team title.

Harr said some opposing coaches then raised concerns, saying she should continue to play with the girls as an individual, rather than being allowed to play for the boys' team.

After the activities association board voted to consider the proposed change in July, Harr, who is the No. 3 ranked female golfer in Idaho with a 2.2 handicap, openly campaigned against it.

"The mental mind set a golfer gains from golfing for a team cannot be replaced," she wrote to the association.

Before the vote, lawyers who work on discrimination cases in sports also told the AP that federal Title IX provisions would likely make the proposed rule change illegal because barring Harr from the boys' team, in the absence of a girls' squad, would deny her access to equal educational opportunities.

Billetz, the association director, said there was no discussion among board members about Title IX before their decision.

"The bottom line was, this is something that was just like an anomaly," he said.

Dragster sets speed record with cheesy biofuel

A dragster powered by biofuel brewed from cheese-making waste has set a blistering land-speed record for a one liter, two cylinder engine of 64.4 miles per hour.?

?That, in that class, is fast,? Lance Seefeldt, a professor of chemistry and biochemistry at Utah State University, told NBC News on Tuesday.

Since no record existed for that size engine prior to Seefeldt's cruise down the Bonneville Salt Flats earlier this month, the the professor and his colleague first?set the ?record with petroleum-derived diesel.

?Then we backed it up with the biodiesel we made from the waste cheese process,? Seefeldt said.?

The waste is sugars that a yeast strain converts into oils that are then developed into biodiesel with a patent-pending procedure, he explained.

The team is also making biofuels with bacteria as well as microalgae, which convert carbon dioxide into fuel with energy from the sun.?

They?ve tested all three in the lab and found them to ?match commercial biodiesel in every way and, in some ways, they are even superior to petroleum diesel,? Seefeldt said.

For example, they burn cleaner and thus produce fewer air pollutants such as nitrogen oxides, he said.

While the process to create the fuels is currently at the lab, proof-of-concept stage, the team can produce the yeast-derived version in gallon quantities.

That?s enough, they reckoned, to test the fuel in a small engine, so they built the Aggie-A-Salt dragster and raced at the Utah Salt Flats Racing Association?s 2012 World of Speed event.?

Now that the record is set, the team is back in the lab scaling up the bacteria and microalgae processes to produce enough fuel to race with them next summer.

?We want to run them head-to-head against each other at our top speeds, which we?re confident will be much faster next year,? Seefeldt said.

If all continues to go well, he added, the raw materials to produce these fuels at commercial scales is readily abundant.

The cheese factory where the team sources their waste material, for example, produces enough in a day for 66,000 gallons of fuel.

?You could multiply that across the country and different waste streams and, so it is infinitely scalable,? Seefeldt said.?

If the?technology is also able to compete in price with fossil fuels, then our future really could be cheesy.

40 Days of Meditation #Zensperiment: Bring Friends | Greatist

This is Week 3 of 5 in Shana Lebowitz?s #zensperiment series. Catch up on?Week 0?(why she?s learning to meditate),?Week 1?(meditating in real life), and Week 2 (challenges of meditation).

Last weekend the Greatist Team headed to Garrison, NY, for our very first company retreat. Over the weekend I was scheduled to lead the group in a short meditation session. Finally my #zensperiment would go from a solitary activity to an interactive experience with people I really care about. I share pretty much everything with the Greatist Team ? headphones, mixed nuts, toilet paper ? and sharing these few minutes of soul-searching would really put our bonds to the test.

For four days we took over a gorgeous colonial house ? the wood-floored, checkered-tablecloth, tire-swing kind that everyone secretly dreams of living in when they grow up. Friday morning we sat on the floor of the porch, squinting in the mid-morning sunshine. There were silky cushions about a foot apart and I positioned myself to face the group.

Since beginning this meditation project, I?d gone to lessons in Zen and shamatha meditation, both of which involved a single instructor leading a group of relative newbies in the art of mindfulness. Now, sitting cross-legged on the porch floor, still in leggings and a tank top from our morning run, my hair a knotted mess around my head, I thought about those instructors. I knew I wouldn?t be poised like Rachel, at ease like Terrence, and felt more than a little like a Zen fraud.

Quickly, I glanced down at the page in my spiral notebook where I?d jotted down a series of now-illegible instructions about posture and breathing. Start sitting with your legs crossed, I told the team, vertebrae like gold coins stacked on top of one another.

After about 30 seconds, I looked slowly around the room, nodding to myself when I saw everyone looking still and sort of contemplative. I?d meditated in groups before, but I?d always stared at a wall, and seeing what everyone looked like while they practiced felt strange and a little exciting.

We had a brief discussion, meditated again, and I noticed the group was slightly fidgety. Were they getting sick of sitting there, wishing we were doing High-Intensity Interval Training or cooking lunch instead? This time there were complaints: back pain, pins and needles, difficulty sitting up straight for so long.

The truth was, I didn?t know what to tell them. My back also hurt when I sat meditating for a while, and the pain didn?t go away the more I practiced, despite what meditation instructors had told me. Someone raised his hand and said he was getting frustrated trying not to think. I wanted to tell him meditation isn?t about ?not thinking,? it?s about letting thoughts pass without judgment, but the words sounded fake and more than a little vague in my mouth. Sunlight was streaming through the glass windows and suddenly the room felt hot and suffocating.

I took a breath in, closed my eyes for half a second, and remembered what one seasoned meditator had told me about observing the sensations in the body as though from a third-person perspective. See if that helps some of the discomfort, I told them. One staffer sitting quietly in the corner said she?d learned to say ?thank you? every time a thought pops up while she?s trying to meditate. There were giggles.

I asked if everyone would like to close the session with another minute-long meditation, and they nodded their heads eagerly, yes.

Saturday morning we hiked the South Redoubt Revolutionary War Heritage Trail. It was a gorgeous day and the view was literally breathtaking: From the top of the trail you could see West Point military academy, all stone walls and huge grassy fields. After a few minutes I noticed everyone pointing at the picnic table over in an enclosed spot to our right. There they were, Derek, Kelli, and Laura, sitting like triplet prairie dogs, eyes closed, faces turned to the wind, meditating silently.

?They look like they?re waiting for a bus,? someone said, and I laughed, but not really at anything funny. For the first time since starting this meditation project, I felt perfectly at peace.

He?d never made love to a man under 25?not since he?d passed that age himself. He?d never made love to a parishioner, nor to anyone in a position of subservience. Never to a woman because he knew he was gay, or queer as they called it then, by the age of twelve. Didn?t seem fair trying to pretend otherwise at someone's expense. Probably couldn?t have done it anyway.

God would help him find his way. That?s what he eventually decided. God made him like this for a purpose. Frank Jr.?and then after his ordainment Father Bertram--believed that fervently. How could he not?

???????????? He?d only made love with seven men in his life: with a history professor in college, and then with a boy down the hall his senior year, with his roommate in the seminary a few times, and a doctor who?d he?d been sent to with neck problems when he first entered the priesthood, an artist exhibiting his art in a park down the street from his church in Buffalo (only once), a priest in a parish in the Detroit suburbs he?d met at meetings at the archdiocese.

His brother, Howard, was the first. Howard was as fine-featured and slight as Frank Jr. was rough-hewn and large. Was it possible they even shared the same father?

If Frank counted all his sexual encounters with these men over twenty-five years, they?d number less than fifty. He didn?t know how to count the times with his brother. Did what they did in their cold attic room really count as sex? Most of it was touching, caresses, nuzzling. Didn?t all boys do this with other boys? Wasn?t it more about comfort and warmth in their case?

There?d been no other children, or even many people, in their lives back then, living as they did with a mother who rarely left the house except to go to work. Who disliked her boys leaving home.

?They?ll beat you up,? she said. ?You?re the only black boys in this town. And sissy ones to boot.? She?d known before they did.

She came to New Hampshire from New Orleans to cook for a rich white man who favored the Creole cooking she'd been taught, and she went straight from his kitchen to their tiny under-heated, under-furnished house?no stops in between every night. Frank. Jr. and Howard did the shopping, negotiated everything else in the outside world. And at nights, they did what they did. At least, in winter, they could pretend they were keeping warm.

There was no Frank Sr. Never had been. It was years before they cottoned to the fact that Frank Sr. was their mother?s invention. They wondered if they even shared a father but couldn?t ask. Every question, even everyday stuff?like could she sign their permission slip to go to the museum in Concord?seemed to bring her pain, anger.

??????????? Howard killed himself at twenty-three following a dishonorable discharge from the Navy. Frank Jr. decided to become a priest the next year. His mother had moved in with the rich white man by then, something the man wanted, she said.

?Do you share his bed?? Frank Jr. asked in a shuddering voice, as she helped him pack his bags.

She didn?t look up. ?If he wants. I do what he wants.?

His mother was forty-five?the man nearing seventy. He reminded Frank of Colonel Sanders or Mark Twain, some fancy white guy in a loose white suit. Facial hair, red-faced, dour. For Christmas, he?d given the boys school supplies with the admonition to study hard if they wanted a better life. If he gave their mother anything, she didn?t mention it.

?????????? He?d never kill himself, Frank Jr. decided, at his brother?s funeral. He?d use the lesson of his brother?s death, his lonely childhood, his mother?s situation, his own perverse desires, to make himself a better priest.

????????? And he was. He taught history and counseled children, taking on a more prominent role after he moved to Detroit and his parish slowly broadened in skin color, tolerance, language. He learned Spanish, computers, the jargon of children. He was careful to never touch a child, never to favor one. To be watchful of his fellow priests in this regard.

????????? Then came the illness. He ruled out his brother, the professor, the seminary roommate, the boy down the hall at college?all too long ago. And like Father Owens?that was the other priest?s name?he didn?t report the disease. The priesthood and AIDS were not a good fit. Homosexuality and celibacy were at odds. He ignored the symptoms as much as possible, hoping the disease would go away with the new treatments, and for a long time, it seemed more a nuisance than a life-threatening situation.

But because he could not confess his ailment nor pursue treatment openly, superior drugs were excluded from his regimen.

?????????? And suddenly he was in and out of hospitals for weeks at a stretch. The Church didn?t chastise him?it was too late for that. He didn?t try to track his partner, find his mother back in New Hampshire, do what he should have done. Most of the priests he?d known for years stuck by him. But he died alone.

Alone but for the sound of his brother?s voice.

?Frank Jr.? he heard Howard calling, saw his brother putting out a hand. Frank Jr. reached for him..

Bodiless now, souls intact, they could take comfort in each other purely.

??????????????? The last time I saw him it was an early winter morning and raining in B_______, maybe raining all over the world. The sun had disappeared behind a sky of gray slate several days earlier, and the water fell in continuous blowing sheets. Storm drains in the small town were filling up from the endless rain, maybe filling up all over the world. Water holding leaves, candy wrappers and discarded furtive love notes drifted down the gutters everywhere in the neighborhoods and commercial district.

??????????????? The night before I had found much the same rain and flotsam and jetsam downtown, where only a few people were brave enough to be out and about on the streets. They were doing their best to look like strangers in raincoats, galoshes and big umbrellas, but I spotted Miranda?s red scarf right away. She was across the street, heading into the caf?; just like me, she was running a little late for our rendezvous.

??????????????? ?I wasn?t sure I could get away,? she whispered as we sat down in our back corner booth. Angie was already on her way over with two cups of black coffee. ?He was supposed to go to one of his stupid board meetings, but it got cancelled. He finally had enough martinis and passed out on the couch.?

??????????????? At one time that image of my old friend would have bothered me. That was before his wife started to bother me, and not in a bad way. Those days had probably come to a close; now she was beginning to bother me in a bad way indeed. But I was still committed to the plans we had been making for several weeks now.

??????????????? I decided to cut to the chase and pop the question. ?Are you going to be able to get the money?? I tried not to sound too anxious. She was starting to matter to me less and the money more. I got the full effect of her dark hair and green eyes as she stared at me for what seemed so long a time.

??????????????? ?Naturally,? she told me finally. ?I?m on top of it.? And any guy whose help you need, I wanted to add. But then I had to admire my self-restraint. ?I?ll make sure he gets up for his rehab appointment tomorrow morning. He?s missed the last two and that knee isn?t getting any better by itself.?

??????????????? ?And then what?? I knew, of course, but I wanted to hear her say it?again. I loved to watch her lips moving when she talked.

??????????????? Another long stare before she spoke. ?I?m going to open the safe he thinks I don?t know about, empty the contents into my biggest purse, get into my car and meet you at the airport.? She sounded like she was saying that in her sleep, as if she had been practicing that sentence over and over.

??????????????? Yes, that was the plan, simple and easy as long as we could leave the country quickly. Neither of us said anything for a while; we just sipped our coffees and considered the possibilities. We could hear the rain hammering against the caf??s glass windows and sounding almost like gunshots in the distance.

??????????????? ?Anything I need to bring besides the new passports and stuff?? I tried to keep my tone light.

??????????????? She put her right hand under the table and ran her fingers up my left leg. ?No, honey, you?ve got everything else I need on you already.?

??????????????? Until the past few weeks that might have been enough for me; I would have executed the plan just as she designed it. I?m the usual sucker for a beautiful woman with a great body and an overwhelming personality. But lately cracks in the wall of that future had appeared. The phone caller didn?t tell me his name, but before long I figured out who he was representing.

????????????? He knew all of Miranda?s movements, including her ?spa? appointments in the city. He told me when and where and to be there. I hung up. We did this dance for a while and then finally I took his dare. Late one afternoon I followed her up the Interstate and discovered everything I needed to know.

?????????? This time nothing Miranda could do would make any difference. We finished our coffee and left the caf? one at a time. The rain blowing on the glass still sounded like gunshots.

?????????????? ? ? And that?s a true account of what happened to me on the night before the last time I saw Frank, Jr. As far as the last time I did see Frank, Jr.---well, that?s another story. Right now, I have some cash to spend.

Privatizing Israel&#39;s Legal System | Global Research

Israel?s Mandatory Arbitration Bill (MA) is troubling. Justice Minister Yaakov Neeman proposed it. It mandates compulsory arbitration for civil suits filed in Magistrate Courts.

The Court president or deputy may order it. Litigants have no say. Neeman claims it?s needed to reduce excessive case loads. His hidden agenda has other things in mind. Judicial fairness will be compromised if he prevails.

On September 4, Knesset members discussed it ahead of second and third readings. Strong opposition exists. More on that below.

Arbitration is an alternate form of dispute resolution. It?s common in commercial disagreements. Costly litigation is avoided. So are conventional court proceedings.

When voluntary, both sides agree to let an arbitrator or arbitral panel review evidence and impose binding rulings.

Mandatory arbitration is more controversial. It lets one party impose its will on another. In commercial disputes, companies have bargaining power at the expense of consumers. Litigation rights are denied. So are class actions. Unfair proceedings result. Outcomes may be predetermined.

Israel?s MA bill lets courts forward civil suits to private lawyers. They?ll become designated arbitrators. Litigants can?t sue.

The Association for Civil Rights in Israel (ACRI) said this measure ?has no equivalent anywhere in the world.? If enacted, Israeli judicial fairness will be severely compromised.

ACRI, Israeli Supreme Court President Asher Grunis, retired justices, and prominent jurists oppose the bill for good reason.

ACRI attorney Anne Suciu calls it step one toward privatizing Israel?s courts. Doing so will severely damage judicial fairness. Unlike judicial vetting, the main qualification for arbitrators is seven years seniority.

Another is the absence of frequent conflicts of interest between his or her proposed arbitral status and outside financial interests.

According to legislative language, individuals with some, but not too many, conflicts are eligible. Moreover, no limitation is placed on ones considered minor. No definition explains.

Growing criticism in some countries led to greater protection for weaker parties in arbitration disputes. Israel?s measure denies it. According to Suciu:

?Years of under-funding led to an unbearable burden on the court system. Instead of solving this problem by amending the system, many decision-makers blindly accept the view that privatization is the desired solution for almost every public service that is not properly functioning.?

?The Mandatory Arbitration Bill is an extreme initiative that has no equivalent anywhere in the world, and it could violate the basic right to a due process.?

Israel?s Basic Law states that ?person(s) vested with judicial power shall not, in judicial matters, be subject to any authority but that of the Law.?

Legal provisions are intended to ensure judicial independence. Qualifications for judges are strict. They include ethical standards, salaries, length of service, termination of service, and others. According to Israeli Supreme Court Judge Ayala Procaccia:

?We set the standards of behavior that apply to specific judges. They are subject to strict standards of conduct not only judgment, but also in other walks of life?.They have to understand that the judgment is not just a job. It is a way of life.?

Suciu believes that transferring civil jurisdiction authority to private parties reflects a ?simplistic and flawed judicial role of a specific solution to the conflict between? two parties.

Doing so ignores ?competent court of law interpretation,? longstanding social values, fundamental rights and obligations, and rule of law priorities.

Civil litigation is a right. It plays a key role in democratic societies. Privatizing the judiciary compromises freedom. Israel?s MA bill raises fundamental constitutional issues. It?s excessive and unreasonable. It damages the public?s trust in courts.

According to Supreme Court Judge Mishal Hashin, judicial access is ?an essential basic right.? It?s also ?the life blood of the court. (When) the path to the court is obstructed, whether directly or indirectly, or even partially, it undermined the raison d??tre of the judiciary.?

At the same time, legal procedures and laws aren?t absolute. Times change, and so do they. Doing so should strengthen democracy, not compromise it. Denying judicial access is dangerously unreasonable.

Privatizing judicial authority compromises basic rights. Mandatory arbitration undermines its intended purpose. Strict regulations, ethics standards, and a supervisory system govern judges.

Grunis isn?t alone. Other bill opponents include Knesset members, the Israel Bar Association, senior jurists, ACRI, and other legal experts concerned about privatizing legal procedures.

Neeman?s history is checkered. Previous initiatives he supported empowered the executive and legislative branches at the expense of the judiciary. He?s no friend of judicial fairness and other democratic values.

MA bill critics call it poorly designed. It?s rife with provisions likely to compromise judicial independence, due process, judicial relief, and other constitutional protections.

Litigants also have no say. If ordered to arbitration, they?ll be shut out of conventional judicial proceedings. Labor MK Isaac Herzog accused Neeman of trying to pull off a ?revolution.? He also said he was undercutting Grunis? authority.

Overburdened court dockets don?t justify compromising judicial fairness. Instead of arbitrators, Israel?s Bar Association urged appointing temporary judges during overload periods.

Israel long ago headed down a slippery slope. Its democracy is seriously flawed. It?s more hypocrisy than real. Mandatory arbitration assures further weakening. Political reality can?t hide disturbing attempts to transform its deficiencies into strengths.

Arabs never had rights. Jewish ones are eroding en route to eliminating them altogether. Israel isn?t just a pariah state. It?s a failed one. It?s just a matter of time before concealing it becomes impossible.
